On February 17, 2009, President Barack Obama signed the American Recovery and Reinvestment Act of 2009 (the “Stimulus Act”) into law. Title XIII, Division A and Title IV, Division B of the Stimulus Act, referred to collectively as the Health Information Technology for Economic and Clinical Health Act (the “HITECH Act”), include provisions intended to promote increased capital investment in health care technology infrastructure and promulgation and adoption of policies and standards to facilitate development and implementation of a nationwide health information network and to provide economicand other incentives to physicians and other health care providers to promote adoption and implementation of electronic health records (“EHRs”). The Act provides for approximately $20 billion in federal funding to accomplish these goals.
