On May 5, 2010, the Center for Medicare and Medicaid Services (“CMS”) issued an interim final rule that implements certain key elements of the Patient Protection and Affordable Care Act (the “Health Reform Act”).  Among other things, the new rule requires that (i) with limited exceptions, suppliers and providers of Medicare items and services must obtain an NPI and include it in all claims for reimbursement; (ii) DMEPOS items must be ordered or referred by a physician or “other eligible professional” and the claim includes such individual’s NPI; (iii)  claims for home health services will be rejected unless the service is ordered or referred by a physician, and the claim includes the physician’s NPI; and (iv) physicians suppliers and providers must maintain certain documentation for seven (7) years, and make such information available to CMS on request.
